REQUEST 

Please provide the following details for all recorded incidents of exposure from 1st January 2022 to the present date: 

 

1. The date and time of each recorded incident. 
2. The specific location of each incident (e.g., park, street name, shopping area, public transport). 
3. The outcome of each case, including: 

• Arrests made 
• Cautions issued 
• Charges brought and case outcomes (conviction, dropped, ongoing investigation, etc.) 

 

RESPONSE

 

We conducted a search on our crime and incident recording system (NICHE RMS) for all offences recorded between the dates 01/01/2022-27/03/2025 under the following Home Office code:

 

• 88E/88/9: Exposure (Replaces classification 139 Indecent Exposure)

 

This search retrieved 767 results.

 

Please be advised that this search has been conducted under the crime date and not by the reported date. This means that any results brought back will relate to crimes recorded between 1st January 2022 and 27th March 2025 and not when the incidents were first reported. Therefore, results retrieved may contain incidents that were reported before 1st January 2022.

Section 40(2) - Personal Information

 

Section 40(2) is an absolute class-based exemption and therefore the authority is not required to consider the public interest in disclosure.

 

The Data Protection Act covers processing of personal data about a living individual.  Personal data means data which relate to a living individual who can be identified-

 

1. from those data, or
2. from those data and other information which is in the possession of, or is likely to come into the possession of, the data controller or any other person in respect of the individual.

 

Information will “relate to” a person if it is about them, linked to them, has some biographical significance for them, is used to inform decisions affecting them, has them as its main focus or impacts on them in any way.

 

If we disclosed these details, this would provide significant detail which could identify an individual and would breach the first principle of the Data Protection Act 2018.

 

In accordance with the Act, this letter represents a refusal notice for this part of your request.
