REQUEST

I am writing to you under the Freedom of Information Act 2000 to request the following information from South Wales Police relating to offences under Clause 66B of the Sexual Offences Act 2003. Please may you provide me with:

• The number of offences under Clause 66B of the Sexual Offences Act 2003 reported to South Wales Police since 1st January 2024

• The total number of charges for summary offences under Clause 66B of the Sexual Offences Act 2003 brought by South Wales Police since 1st January 2024; and the number of convictions resulting from these charges.

• The number of cases relating to offences under Clause 66B of the Sexual Offences Act 2003 referred to the Crown Prosecution Service by South Wales Police since 1st January 2024.

RESPONSE

Question 1

A search has been conducted for the following Home Office (HO) offence codes between 1^st January 2024 and 2^nd June 2025 (the date of your request) retrieved from our crime and incident recording system (Niche RMS).

HO codes:

• 088/15: Sharing intimate photograph or film to cause alarm, distress or humiliation, or for sexual gratification – Sexual Offences Act 2003 Sec 66B, (2) (3) and (10)
• 088/15: Threaten to share intimate photograph or film – Sexual Offences Act 2003 Sec 66B (4) (10)
• 175/08: Share photograph or film of person in intimate state without consent – Sexual Offences Act 2003 Sec 66B (1) and (9)

Please see the below table that provides the number of crimes retrieved broken by the HO code:

Please be advised, this data has been retrieved by searching on the crimed date. This does not mean the occurrence was first recorded in that particular time frame. This means that the occurrence was recorded as a crime between 1^st January 2024 and 2^nd June 2025.

Questions 2 & 3

A second search has been conducted on the above-mentioned HO codes for all crimes that had received an outcome between 1^st January 2024 and 2^nd June 2025 (the date of your request) retrieved from Niche RMS.

Please see the below table that provides the number of charges retrieved broken by the HO code:

Please be advised, this search has been conducted under the outcome date and not by the crimed date. This means that any results brought back will relate to crimes that received an outcome between 1^st January 2024 and 2^nd June 2025.

Please also be aware that the figures provided in question 2 do not relate to the figures provided in question 1. This is because the two searches have been conducted using different methodologies and therefore will retrieve different results.

In regards to the figures provided in question 2, most of the crimes that received an outcome between 1^st January 2024 and 2^nd June 2025 received the outcome types ‘Evidential difficulties [victim does not support]’, ‘Evidential difficulties [victim supports]’ and ‘Investigation complete [no suspect identified]’. Therefore, the number that received the outcome type ‘Charged/Summonsed’ will appear low.

Please be advised that cases referred to the Crown Prosecution Service and any that resulted in conviction is held by the courts and you may wish to redirect this part of your request to them.
